TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of blueforgenc.com and, when incorporated into or referenced by an accepted estimate, proposal, service agreement, change order, or other written authorization, the services provided by Blue Forge Pressure Washing LLC.
Blue Forge Pressure Washing LLC may be referred to as “Blue Forge,” “we,” “us,” or “our.” The person or organization requesting, authorizing, or receiving services may be referred to as the “Customer,” “you,” or “your.”
By accessing or using the website, you agree to the website-use provisions of these Terms.
Submitting a quote request does not create a service contract. Service-related provisions become binding when you accept a Blue Forge estimate, proposal, or Proposal & Service Agreement that incorporates or references these Terms and Blue Forge confirms the service.
1. BUSINESS INFORMATION

The website is used primarily to provide business information and collect quote requests.
Blue Forge does not use Shopify checkout to schedule or process payment for Blue Forge services. Estimates, proposals, approvals, scheduling, invoices, credit-card payments, and ACH payments may be handled through QuickBooks or another identified business system.
2. ELIGIBILITY AND AUTHORITY TO REQUEST SERVICES
You must be at least 18 years old and legally capable of entering into a contract to approve Blue Forge services.
By requesting or approving work, you represent that you:

Own the property, vehicle, equipment, or worksite involved;

Are an authorized property manager, company representative, agent, or other authorized decision-maker; or
-
Have obtained all permission required from the owner, landlord, property manager, homeowner association, co-owner, fleet owner, tenant, occupant, or other person with controlling authority.
A renter or tenant must obtain any landlord, owner, or property-management authorization required by the lease, management rules, or applicable law before authorizing work.
You are also responsible for obtaining any required HOA, municipal, commercial-property, landlord, or site-management approval.
Blue Forge may request written proof of authority and may delay, suspend, or decline work if ownership or authorization is disputed or unclear.
The Customer is responsible for direct costs, delays, or third-party claims resulting from falsely representing authority or failing to obtain required approval, except to the extent caused by Blue Forge’s negligence or wrongful conduct.
3. WEBSITE INFORMATION AND EXAMPLE PRICING
Website descriptions, photographs, videos, service examples, pricing examples, project examples, and other website content are provided for general information.
They are not guaranteed quotes, contractual offers, or promises that a specific property will receive the same result or price.
Final pricing may depend on factors including:

Size and quantity;
-
Surface material;
-
Condition and buildup;
-
Height;
-
Access;
-
Landscaping;
-
Drainage;
-
Water availability;
-
Obstacles;
-
Required protection;
-
Staining;
-
Safety conditions;
-
Cleaning method;
-
Travel or return visits;
-
Other site-specific conditions.
Only the scope and price contained in an accepted written estimate, proposal, or Proposal & Service Agreement are binding.
4. QUOTE REQUESTS
A quote request is a request for Blue Forge to review a potential project.
Submitting a quote request:
-
Does not guarantee that Blue Forge will accept the project;
-
Does not create a scheduled appointment;
-
Does not reserve a date or time;
-
Does not guarantee website example pricing;
-
Does not obligate the Customer to proceed;
-
Does not obligate Blue Forge to perform the work.
You agree to provide reasonably accurate and complete information regarding the requested work, property, access, surfaces, site conditions, water supply, stains, hazards, and other relevant conditions.
Blue Forge may request photographs, measurements, additional information, or an on-site inspection before preparing or finalizing a quote.
Blue Forge may decline work that is outside its service scope, equipment capability, service area, scheduling availability, safety standards, or environmental limitations.
5. REMOTE AND ON-SITE ESTIMATES
A remote estimate may be based on information, measurements, descriptions, photographs, mapping tools, customer statements, or other information available before Blue Forge visits the property.
A remote estimate may be revised if actual conditions differ materially from the information used to prepare it.
An on-site estimate is based on conditions reasonably visible at the time of inspection. Hidden conditions, inaccessible areas, later changes, newly created obstructions, weather effects, other contractors’ work, or deterioration occurring after inspection may affect the final scope, price, or schedule.
Blue Forge will discuss material scope or price changes before performing additional chargeable work.
6. PROPOSALS, ACCEPTANCE, AND SCHEDULING
No work is scheduled until:

The Customer accepts the applicable estimate, proposal, or Proposal & Service Agreement;

Any required deposit is received; and
-
Blue Forge confirms the appointment.
An estimate or proposal is valid until the expiration date stated in that document. Blue Forge may revise or withdraw an unaccepted estimate when conditions, costs, availability, or scope change.
A requested date is not guaranteed until Blue Forge confirms it.
Electronic acceptance, an electronic signature, approval through QuickBooks, or other written electronic approval may be used to form the service agreement.
7. ORDER OF PRECEDENCE
If documents conflict, the following order generally controls:

A later written and approved change order or revised estimate;

The accepted Proposal & Service Agreement;
-
The accepted estimate or proposal;
-
These Terms;
-
Website descriptions, advertisements, informal messages, or general marketing materials.
Project-specific written terms control over general website language.
The Privacy Policy controls regarding the collection, use, retention, disclosure, and protection of personal information.
8. SCOPE OF WORK
Only services, areas, quantities, exclusions, and prices specifically listed in the accepted proposal or agreement are included.
Work not specifically listed is excluded.
Unless expressly included, Blue Forge is not responsible for:

Repairs;
-
Restoration;
-
Painting;
-
Sanding;
-
Staining;
-
Sealing;
-
Construction work;
-
Structural correction;
-
Mold remediation;
-
Biohazard cleanup;
-
Pest remediation;
-
Hazardous-waste handling;
-
Major debris removal;
-
Junk hauling;
-
Work performed by another contractor;
-
Other services outside the accepted written scope.
Additional work requested before or during service requires Blue Forge approval and may require an updated estimate, change order, additional payment, or a different appointment.
Written approval may include approval through QuickBooks, email, text message, or another clear electronic record.
9. CUSTOMER PREPARATION
Before Blue Forge arrives, the Customer must reasonably prepare the work area.
Depending on the service, preparation may include:

Moving or securing vehicles;
-
Removing furniture and decorations from the work area;
-
Securing flags, signs, planters, grills, tools, and loose objects;
-
Closing and locking doors and windows;
-
Confirming that doors, windows, seals, and openings are reasonably watertight;
-
Securing pets;
-
Keeping children and occupants away from active work areas;
-
Providing required access;
-
Moving fragile or valuable property;
-
Coordinating with tenants, employees, contractors, or occupants;
-
Identifying areas that must not be cleaned.
Blue Forge may delay, modify, or decline work when preparation is incomplete or conditions prevent safe and reasonable performance.
Blue Forge is not responsible for damage to loose, unsecured, hidden, improperly installed, or fragile items that the Customer was instructed or reasonably expected to remove or disclose, except to the extent caused by Blue Forge’s negligence.
10. PROPERTY ACCESS
The Customer must provide safe, lawful, and reasonable access to the work area.
Access requirements may include:

Unlocked gates;
-
Clear driveways;
-
Available parking;
-
Removal or relocation of vehicles;
-
Access to exterior sides of buildings;
-
Access to water connections;
-
Access to electrical service when required;
-
Coordination with tenants or occupants;
-
Permission to enter a commercial or managed property;
-
Temporary or one-time access codes when necessary.
Whenever reasonably possible, Customers should provide a temporary or one-time access code instead of a permanent code.
Blue Forge may refuse to use or retain unnecessary permanent security credentials.
11. FAILED ACCESS AND TRIP FEE
A $75 failed-access or trip fee may apply when Blue Forge arrives for a confirmed appointment but cannot reasonably begin or safely continue because of a Customer-controlled or site-controlled condition.
Examples include:

A locked gate;
-
A blocked driveway or work area;
-
Vehicles remaining in the work area;
-
Unsecured or aggressive animals;
-
No access to the property;
-
No required owner, tenant, manager, or site authorization;
-
An owner, tenant, or management dispute;
-
Active construction blocking the area;
-
Other contractors creating unsafe or inaccessible conditions;
-
Unavailable or unusable water;
-
Unavailable required electricity;
-
Incomplete Customer preparation;
-
An occupant refusing access;
-
Conditions materially different from what was disclosed;
-
A Customer or site representative causing an unreasonable delay.
The fee may also apply when Blue Forge has mobilized personnel and equipment but the site is not reasonably ready.
An additional return visit may require separate scheduling and may affect the price.
The failed-access fee does not apply when Blue Forge is unable to perform because of Blue Forge’s own error or when Blue Forge reschedules for weather, safety, equipment failure, or another Blue Forge operational reason.
Blue Forge may waive the fee at its discretion based on the circumstances.
12. WATER, ELECTRICITY, AND UTILITIES
Unless the written proposal states otherwise, the Customer authorizes Blue Forge to make reasonable use of the property’s available water supply.
The Customer must disclose known:

Well-water limitations;
-
Low water pressure or low flow;
-
Water restrictions;
-
Septic-system concerns;
-
Irrigation systems;
-
Shutoff locations;
-
Electrical limitations;
-
Damaged outlets;
-
Exposed wiring;
-
Shared utilities;
-
Other utility or access restrictions.
The Customer is responsible for ordinary utility costs associated with the authorized service.
If required utilities are unavailable or inadequate, Blue Forge may modify, delay, reschedule, or decline the work.
Blue Forge is not responsible for failure of a defective, undersized, improperly maintained, or pre-existing utility system, but remains responsible for direct damage caused by Blue Forge’s negligence.
13. DISCLOSURE OF PROPERTY CONDITIONS
The Customer must disclose known conditions that could affect safety, cleaning, access, or the risk of damage.
These may include:

Leaks;
-
Failed seals or caulk;
-
Loose siding;
-
Loose paint;
-
Oxidation or chalking;
-
Damaged stucco;
-
Weak mortar;
-
Cracked concrete;
-
Exposed aggregate;
-
Rotted or deteriorated wood;
-
Loose fixtures;
-
Damaged gutters;
-
Unsecured cameras;
-
Exterior electrical components;
-
Low-voltage wiring;
-
Solar equipment;
-
Irrigation controls;
-
Pools, ponds, or water features;
-
Sensitive plants;
-
Delicate coatings;
-
Previously damaged surfaces;
-
Prior pressure-washing damage;
-
Known drainage problems;
-
Underground or concealed hazards.
Blue Forge may conduct a visual inspection or test spot, but Blue Forge is not responsible for conditions that were concealed, inaccessible, latent, or not reasonably discoverable.
14. PRE-EXISTING AND HIDDEN CONDITIONS
Cleaning can reveal or worsen the visible appearance of a pre-existing defect.
Examples include:

Loose or failing paint;
-
Oxidized siding;
-
Failed caulk;
-
Deteriorated seals;
-
Weak mortar;
-
Cracked concrete;
-
Exposed aggregate;
-
Wood decay;
-
Rust;
-
Efflorescence;
-
Prior wand marks;
-
Improper installation;
-
Previously concealed discoloration;
-
Water intrusion;
-
Surface delamination;
-
Existing chemical damage.
Blue Forge is not responsible for pre-existing, concealed, latent, structurally deficient, improperly installed, or deteriorated conditions.
Blue Forge remains responsible for direct damage caused by its negligence.
15. CLEANING METHODS AND CHEMICALS
Blue Forge selects cleaning methods based on the surface material, condition, buildup, access, safety, surrounding property, and the accepted scope.
By accepting a proposal that includes cleaning services, the Customer authorizes Blue Forge to use commercially appropriate methods and products, which may include:

Low-pressure application;
-
Pressure washing;
-
Surface cleaning;
-
Detergents;
-
Surfactants;
-
Sodium hypochlorite solutions;
-
Degreasers;
-
Spot treatments;
-
Rinsing agents;
-
Other commercially appropriate cleaning products.
Blue Forge may adjust product choice, dilution, dwell time, pressure, temperature, application method, or sequence after inspection or test spotting.
Acid-based products or specialty stain-removal chemicals will not be used unless specifically listed in the proposal or separately approved.
A method change that does not materially change the accepted scope or price does not require a new agreement.
Material changes to scope or price require Customer approval.
16. CLEANING RESULTS AND STAIN LIMITATIONS
Blue Forge will use commercially reasonable methods appropriate for the accepted scope.
Blue Forge does not guarantee that every stain, mark, discoloration, or condition will be removed.
Conditions that may not be fully removable include:

Oil;
-
Rust;
-
Paint;
-
Mineral deposits;
-
Oxidation;
-
Artillery fungus;
-
Efflorescence;
-
Battery or chemical stains;
-
Fertilizer stains;
-
Irrigation stains;
-
Tire marks;
-
Deeply embedded discoloration;
-
Permanent surface damage;
-
Prior pressure marks;
-
Aged or failed coatings.
No promise is made that an old, stained, oxidized, deteriorated, damaged, or weathered surface will look new.
Differences in age, porosity, repairs, previous treatments, sun exposure, drainage, material batches, and existing wear may produce uneven results.
Organic growth may return after service because of moisture, shade, drainage, landscaping, weather, or environmental conditions.
17. LANDSCAPING AND PROPERTY PROTECTION
Blue Forge will use reasonable procedures intended to protect landscaping, glass, painted surfaces, metals, fixtures, surrounding property, and other areas near the work.
The Customer must identify sensitive plants, recently installed landscaping, damaged vegetation, delicate metals, specialty coatings, pools, ponds, fountains, pets, and known chemical sensitivities before work begins.
Temporary chemical odor, moisture, noise, overspray, wet surfaces, and runoff may occur during normal cleaning operations.
Blue Forge is responsible for direct damage caused by negligent chemical use or negligent performance, but not for pre-existing plant stress, disease, drought damage, improper landscaping, hidden defects, or conditions outside Blue Forge’s reasonable control.
18. RUNOFF AND ENVIRONMENTAL CONDITIONS
Blue Forge will use reasonable runoff and environmental controls appropriate to the service and site.
Blue Forge will not knowingly direct wash water or cleaning chemicals into a storm drain.
Work may be modified, delayed, limited, or declined when:

Site drainage is inadequate;
-
Runoff cannot be reasonably controlled;
-
Water recovery beyond Blue Forge’s available capability is required;
-
A municipal, property-management, environmental, or site rule prevents the proposed method;
-
The site presents an environmental or safety concern.
The Customer must disclose known drainage restrictions, private stormwater systems, sensitive waterways, wells, septic systems, ponds, pools, or other environmental concerns.
19. SAFETY AND HAZARDOUS CONDITIONS
The Customer, occupants, children, employees, tenants, visitors, and pets must remain clear of active work areas and comply with reasonable safety directions.
Wet surfaces may be slippery. Hoses, equipment, vehicles, electrical connections, and cleaning products may create temporary hazards during service.
Blue Forge may immediately stop, modify, or decline work involving:

Aggressive animals;
-
Live electrical hazards;
-
Unstable structures;
-
Suspected asbestos or lead hazards;
-
Sewage;
-
Human or animal waste;
-
Medical waste;
-
Needles or sharp hazards;
-
Biohazards;
-
Unknown chemicals;
-
Illegal activity;
-
Threatening conduct;
-
Unsafe traffic conditions;
-
Other conditions presenting an unreasonable risk.
A delay or refusal based on a good-faith safety concern is not a breach of the service agreement.
20. SCHEDULING, BUSINESS HOURS, AND HOLIDAYS
Scheduled dates and arrival windows are estimates unless Blue Forge expressly states otherwise in writing.
Published business hours are general communication hours and are not guaranteed work hours or guaranteed response times.
Blue Forge may modify hours, close, or limit service because of:

Federal or state holidays;
-
Family or personal emergencies;
-
Illness;
-
Equipment maintenance;
-
Staffing limitations;
-
Training;
-
Business operations;
-
Other reasonable circumstances.
Blue Forge will make reasonable efforts to communicate material scheduling changes.
21. WEATHER, EQUIPMENT, AND OPERATIONAL DELAYS
Exterior cleaning and related property services are dependent on weather and site conditions.
Blue Forge may delay, stop, or reschedule work because of:

Rain;
-
Lightning;
-
Thunderstorms;
-
High winds;
-
Extreme heat;
-
Freezing temperatures;
-
Ice;
-
Severe weather forecasts;
-
Unsafe surface temperatures;
-
Water restrictions;
-
Flooding;
-
Poor drainage;
-
Equipment failure;
-
Vehicle failure;
-
Utility failure;
-
Road closures;
-
Illness;
-
Government orders;
-
Safety concerns;
-
Other operational conditions affecting safe or reasonable performance.
Blue Forge may make this decision based on actual conditions, forecasts, manufacturer recommendations, safety judgment, or the likelihood that conditions will affect work quality.
Blue Forge does not charge the Customer a cancellation or rescheduling fee when Blue Forge reschedules for weather, safety, holidays, equipment failure, or another Blue Forge operational reason.
Such a delay does not constitute abandonment or breach of the agreement.
22. CUSTOMER CANCELLATION AND RESCHEDULING
Customers should provide at least 24 hours’ notice when requesting cancellation or rescheduling.
Notice may be provided by phone, text, or email.
Blue Forge does not impose a general late-cancellation fee under these Terms solely because less than 24 hours’ notice was given.
However, the $75 failed-access or trip fee may apply if Blue Forge has already arrived or mobilized and cannot reasonably begin because of Customer or site conditions.
Repeated last-minute cancellations may affect future scheduling availability or may require a deposit before a future appointment.
Deposits apply only when specifically stated in the written estimate or proposal.
Nothing in these Terms waives a cancellation right that cannot legally be waived.
When a separate statutory Notice of Cancellation is required by applicable law, that separate notice will control.
23. DEPOSITS
Blue Forge may require a deposit for certain projects, materials, scheduling commitments, specialty services, or larger scopes.
A deposit is required only when stated in the written estimate or proposal.
The proposal will state:

The deposit amount;
-
When it is due;
-
Whether it is refundable;
-
How it will be applied;
-
Any project-specific cancellation conditions.
If Blue Forge permanently cancels a project and does not perform the associated work, Blue Forge will refund any unearned deposit, subject to lawful deductions or completed work.
24. PAYMENT
Payment is due according to the accepted estimate, proposal, or invoice.
Blue Forge may accept credit-card and ACH payments through QuickBooks Payments.
The Customer is responsible for:

Approved service charges;
-
Approved scope changes;
-
Applicable taxes;
-
Authorized trip or failed-access fees;
-
Other charges expressly accepted in writing.
A declined, reversed, disputed, or failed payment does not eliminate the Customer’s responsibility for valid charges.
Blue Forge may pause additional work or future scheduling while an undisputed balance remains unpaid.
Customers should promptly contact Blue Forge regarding a billing concern so the matter can be reviewed before unnecessary escalation.
Nothing in these Terms eliminates a Customer’s lawful rights concerning payment disputes or chargebacks.
25. REFUNDS AND PARTIALLY COMPLETED WORK
Because Blue Forge provides services rather than returnable merchandise, payments for properly completed work are not automatically refundable.
A result limitation that was disclosed before service, such as permanent staining, oxidation, surface deterioration, or incomplete stain removal, does not automatically create a right to a refund.
When Blue Forge cannot complete all approved work:

The Customer may be charged for the portion reasonably completed;
-
Unperformed work may be removed or adjusted from the invoice;
-
Blue Forge may reschedule the remaining work;
-
Any refund or credit will be based on the actual circumstances and accepted agreement.
Nothing in this section limits rights relating to negligent, unauthorized, materially deficient, or unlawful work.

26. CUSTOMER CONCERNS AND OPPORTUNITY TO INSPECT
The Customer should inspect the completed work when reasonably possible.
Visible concerns should be reported promptly, preferably within 48 hours after service, so Blue Forge can inspect the condition while the work and site conditions remain reasonably recent.
Blue Forge must be given a reasonable opportunity to inspect and, when appropriate, re-clean or correct the affected area before another contractor alters the condition.
This does not prevent the Customer from taking reasonable emergency action necessary to prevent additional damage or address an immediate safety concern.
The 48-hour reporting request does not waive non-waivable legal rights or claims involving damage that could not reasonably have been discovered during that period.
27. PHOTOGRAPHS AND DOCUMENTATION
Blue Forge may take photographs or videos before, during, and after service for:

Pre-existing-condition documentation;
-
Scope verification;
-
Quality control;
-
Work records;
-
Customer communication;
-
Dispute resolution;
-
Safety documentation;
-
Legal or accounting records.
Job-documentation photographs may be retained even when marketing permission is declined.
Blue Forge will request separate affirmative permission before using identifiable Customer-property photographs for advertising, website content, social media, or other marketing.
Declining marketing permission does not affect service eligibility.
Blue Forge will not intentionally publish Customer names, exact addresses, access codes, recognizable faces, children, license plates, or other identifying details unless separately authorized.
28. CUSTOMER-SUBMITTED CONTENT
When you submit photographs, videos, measurements, descriptions, messages, or other information to Blue Forge, you represent that you have the right to provide that material.
You grant Blue Forge a limited right to use the submitted material as reasonably necessary to:

Review the request;
-
Prepare a quote;
-
Communicate with you;
-
Perform the service;
-
Document the job;
-
Maintain business records;
-
Address payment or dispute matters.
Submitting material for a quote does not grant Blue Forge permission to use it publicly for marketing unless separate marketing permission is given.
29. WEBSITE USE AND PROHIBITED CONDUCT
You may use the website only for lawful purposes.
You may not:
-
Attempt unauthorized access to the website or related systems;
-
Introduce viruses, malicious code, or harmful technology;
-
Interfere with website operation;
-
Scrape or harvest personal information;
-
Impersonate another person or organization;
-
Submit false or fraudulent quote requests;
-
Use the website to harass, threaten, or abuse others;
-
Copy or exploit website content for unauthorized commercial use;
-
Circumvent security or privacy controls;
-
Use the website in violation of applicable law.
Blue Forge may restrict or block access when it reasonably believes the website is being misused.
30. INTELLECTUAL PROPERTY
The Blue Forge name, logos, branding, website design, photographs, videos, text, graphics, icons, service descriptions, and other original materials are owned by or licensed to Blue Forge.
They may not be copied, reproduced, altered, distributed, published, sold, or commercially used without written permission, except as permitted by law.
No website access transfers ownership of Blue Forge intellectual property.
31. THIRD-PARTY SERVICES AND LINKS
Blue Forge may use or link to third-party services, including Shopify, QuickBooks, Quo, mapping services, review platforms, social-media platforms, payment processors, and other business technology.
Independent third parties operate under their own terms, privacy policies, availability, and security practices.
Blue Forge is not responsible for the independent acts, omissions, outages, content, or policies of a third-party provider, except to the extent Blue Forge remains legally responsible for its own selection, use, or handling of Customer information.
32. PRIVACY AND RELATED POLICIES

The Privacy Policy is incorporated into these Terms concerning privacy and personal-information practices.
If these Terms conflict with the Privacy Policy regarding personal-information collection, use, disclosure, retention, or protection, the Privacy Policy controls for those matters.
33. ELECTRONIC COMMUNICATIONS AND SIGNATURES
You agree that Blue Forge may communicate with you electronically regarding:

Quote requests;
-
Estimates;
-
Proposals;
-
Appointments;
-
Service changes;
-
Property access;
-
Payment;
-
Invoices;
-
Customer concerns;
-
Other service-related matters.
Electronic communications may be delivered through email, text message, QuickBooks, Quo, or another identified system.
When you electronically approve or sign a proposal, estimate, change order, or agreement, that electronic approval may have the same effect as a handwritten signature, subject to applicable law.
Where legally required, Blue Forge will provide disclosures concerning electronic records, your ability to retain or print them, paper-copy availability, and withdrawal of electronic consent.
You are responsible for providing accurate contact information and updating Blue Forge if it changes.
34. WEBSITE DISCLAIMER
Blue Forge makes reasonable efforts to maintain accurate website information.
However, the website may contain errors, outdated information, temporary interruptions, or content that does not apply to every project.
The website is provided on an “as available” basis for informational and quote-request purposes.
Website availability is not guaranteed.
Nothing on the website replaces the accepted project-specific proposal or agreement.
35. SERVICE STANDARD AND LIMITATIONS OF LIABILITY
Blue Forge will perform accepted services using commercially reasonable care and methods appropriate to the written scope.
Blue Forge is not responsible for loss or damage caused solely by:

Pre-existing or hidden defects;

Customer misrepresentation;

Lack of required authorization;
-
Failure to disclose a known hazard;

Customer failure to prepare the property;
-
Acts of occupants, tenants, contractors, or third parties;

Defective utilities;
-
Unsafe site conditions;
-
Weather;
-
Events outside Blue Forge’s reasonable control;
-
Normal or disclosed cleaning-result limitations.
To the maximum extent permitted by law, Blue Forge is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of business, loss of use, lost profits, or similar economic loss resulting from a delay or disclosed service limitation.
Nothing in these Terms excludes or limits liability for:

Direct damage caused by Blue Forge’s negligence;

Gross negligence;
-
Willful misconduct;
-
Fraud;
-
Any obligation or remedy that cannot legally be excluded or limited.
36. EVENTS OUTSIDE REASONABLE CONTROL
Neither party is responsible for delay or failure caused by events outside that party’s reasonable control, except for payment obligations relating to work already completed.
These events may include severe weather, natural disasters, government action, utility failure, road closure, civil emergency, supply disruption, illness, equipment failure, labor interruption, or other circumstances that could not reasonably be avoided.
The affected party will make reasonable efforts to communicate and resume performance when conditions allow.
37. GOVERNING LAW AND VENUE
These Terms and Blue Forge service agreements are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where another law must apply.
Any legal proceeding must be brought in a court with lawful jurisdiction in North Carolina.
Venue will be in Wake County, North Carolina, to the extent permitted by applicable law.
Nothing in this section deprives a consumer of a right or venue that cannot legally be waived.
38. SEVERABILITY
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed when necessary.
The remaining provisions will continue in effect.
39. NO WAIVER
Blue Forge’s failure to enforce a provision on one occasion does not waive the right to enforce it later.
A waiver must be clear and does not apply beyond the specific situation for which it was given.
40. ENTIRE AGREEMENT
These Terms, the accepted Proposal & Service Agreement, the accepted estimate, approved written changes, and incorporated policies constitute the agreement relating to the project.
Statements or promises not contained in the controlling written documents are not binding unless later confirmed in writing by Blue Forge and the Customer.
41. CHANGES TO THESE TERMS
Blue Forge may update these Terms to reflect changes in services, operations, technology, law, risk management, or business practices.
The updated version will be posted on the website with a revised “Last updated” date and document version.
Website use after an update is governed by the updated website Terms.
A project already accepted remains governed by the version incorporated at the time of acceptance unless Blue Forge and the Customer agree in writing to a change or applicable law requires otherwise.
